Hence, as per the Act of Listening Device Act 1992, Sam is an offender as he committed the offence of using listening device unethically and illegally.
The name of this Act in Australian constitution is the Listening Device Act 1992. Moreover, as per the Act, if anybody records the personal communication for personal interest it will be considered as the criminal offense, and the Criminal Code Ch 2 will be applied in that case. According to the law, an individual should not use a listening device intending for listening or recording a private conversation or communication to which the individual is not a party. In case of the individual is a party of the conversion then also he/she is not allowed to record the conversation, as recording a private conversation without the consent of the other party is a criminal offense (Harvey, 2009). Moreover, for this offense, the maximum penalty according to the Australian constitution is $50. As Sam recorded the conversation of himself with Sally in the party for his interest and he did it secretly without the permission of Sally, hence he is an offender of Listening Device Act 1992.
